Kaysie-Jane Bland was starved of oxygen during her delivery at Wordsley Hospital. Her mother – Jane Robinson – alleged that the hospital was negligent in their treatment of both of them, as staff failed to act on fetal distress. Despite signs that all was not well with the delivery, the medical team failed to deliver Kaysie quicker, and she was left starved of oxygen for 31 minutes during this time.

Kaysie has been left with brain damage, and is unable to walk or talk. Her mother is now her full-time carer, seeing to her extensive care needs.

Although the Hospital has never admitted liability for Kaysie’s injuries, an out of court settlement was agreed between Kaysie’s family and Dudley NHS Foundation Trust. This settlement consists of a lump sum payment with annual payments for the rest of Kaysie’s life to cover her care costs. Although the figures were not released they are considered to be substantial amounts due to the severity of the injuries involved. The decision was approved by Mr Justice Tugendhat at London’s High Court.

After the settlement, the Dudley Group of Hospitals NHS Foundation Trust wished Kaysie and her family all the best for the future.

According to the family’s complaint, Josiah and Jason Miller, his father, took shelter behind one of the tents during a thunderstorm. Several of the tents became dislodged because they were inadequately fastened down, and a large air conditioner attached to one of the tents fell on Josiah, causing fatal injuries.
